Job Description

  • In coordination with legal team to prepare, review, and provide legal advice on all legal documents including loan agreements.
  • Court deals, arranging the execution of mortgages/collaterals, and assisting the ADF in legal or other related matters.
  • Assist legal officer in all legal processes, including but not limited to, credit/loans, lawsuits etc.
  • Assist Loan Recovery team for the recovery of the default loans.
  • File legal cases in the relevant courts against the defaulter borrowers.
  • Execute investigation and gathering factual data regarding the legal status of client’s concerned properties to protect the ADF’s interest
  • In coordination of legal team meet with government officials, property registries, evaluators, and courts to gather information on the legal status of collaterals.
  • In coordination of legal team, represent the ADF in the formal, judicial, and customary legal systems.
  • Participate in judicial sessions and defends the ADF’s interests in court trials.
  • Participate in the prosecution investigation process regarding the ADF’s client and employees.
  • Assist legal officer to write and prepare the defense statement and objection over prosecution appeal in due time.
  • Prepare and file legal cases/reports on behalf of the ADF for various issues related to credit/loans, employees’ etc.
  • To provide a comprehensive progress report on status of the cases with the court and other relevant government department for activities he/she undertook during the week. This report should be submitted to line manager on each weekend.
  • Legal claim against customers who have not paid their loans or have been overdue to the justice and Judicial government Departments.
  • To follow up the cases in DGCs, courts, Law Departments, General Attorney Office, police, and other related government departments.
  • Regularly and continuously representation of the ADF and defending for its interests in all governmental and non-governmental organizations.
  • To prepare and arrange the contracts and all other legal documents required for all the loans
  • Monitor the process of Tazmin Khat (Guarantee Letter) and other court registry required letters.
  • To examine and evaluate the legal status and eligibility of the guarantors for the ADF loans.  
  • To continuous monitor the movable and immovable properties, which are under the guarantee of ADF.
  • To cooperate with all other departments of the organization to speed up the loan disbursement process
  • Other job-related tasks as assigned by the line Manager.

Job Requirements

  • University degree in Law.
  • Having at least 3 years’ experience as a Lawyer in the country.
  • Having valid license from the Afghan authorities to act as a Lawyer.
  • Having proper knowledge of Afghan Laws and juridical system.
  • Excellent negotiation and communication skills.
  • Analytical ability and serious attention to details.
  • Be able to properly communicate in local languages and English.
  • Good knowledge of computer programs such as Word, Excel etc.
  • Being flexible for travels.
